Massachusetts’ 24D Treatment Programs

Massachusetts has adopted a unique substance abuse program known as the 24D Program that many first-time OUI or second-time OUI offenders may be assigned to after a plea or a conviction. The purpose of the 24D Program is to reeducate DUI offenders of the dangers of driving while intoxicated and to provide treatment to those in need. For first time offenders, enrolling in a Driver Alcohol Education Program (DAEP) may also allow a driver to receive a hardship license, which permits the driver to drive every day during a specified twelve hour period.

Drivers who have incurred only a first-time DUI offense, or eligible drivers who have received a single prior OUI conviction more than ten years ago, must attend 40 hours in the DAEP over the course of 16 weeks. Drivers with a prior DUI on their record will be required to complete a fourteen day inpatient treatment program in addition to an aftercare treatment program. The fourteen day inpatient treatment program is completed only at a program at the Tewksbury State Hospital, with aftercare completion opportunities available across the state.

Because even a first offense OUI has reeducation program requirements and license consequences, it is important to speak to an attorney about all of your options prior to accepting responsibility for the offense.
